GENERAL TERMS AND CONDITIONS

MedRoyal s.r.o., ID No.: 241 86 911, with its registered office at Husova 122, CZ 28401 Kutná Hora, file No. C 186791, registered with the Municipal Court in Prague (hereinafter referred to as the “intermediary”) acts as an intermediary between a natural person (hereinafter referred to as the “client”) and a healthcare provider (hereinafter referred to as the “HCP”) who will provide the client with the requested healthcare service (hereinafter referred to as the “procedure”).

These general terms and conditions (hereinafter referred to as “terms and conditions”) define the mutual rights and obligations of the intermediary and the client if they conclude a contract whose subject matter is the mediation of a procedure with the HSP (hereinafter referred to as “contract”).

The contract is concluded on the basis of a prior order by the client (by telephone or email) by sending a so-called “Binding Reservation” (hereinafter referred to as the “reservation”) to the client’s email address. The reservation contains the specified requirements set out in the following paragraph and a reference to these terms and conditions. The contract becomes effective upon payment of the deposit in accordance with paragraph 5 of these terms and conditions.

The essentials of the reservation include, in particular: identification of the contracting parties, consultation date, confirmation of the date of the procedure, specification of the procedure, specification of the PZS, price of the procedure and payment terms, conditions, and others.

The deposit is payable within 5 days of sending the reservation to the client’s email address, to the intermediary’s account: IBAN: DE63 8505 0100 0234 9083 35, BIC: WELADED1GRL. In most cases, the deposit is 20% of the price of the procedure, but at least EUR 400. By paying the deposit, the date of the procedure specified in the reservation becomes binding and the client declares that they are eligible for the procedure. The deposit is refundable only under the conditions specified below in these terms and conditions.

The remaining amount of the price of the procedure, as well as all other costs associated with the procedure, shall be paid directly on site at PZS before the procedure.

7.

The client is required (for some procedures) to undergo a preoperative examination before the planned procedure. The agent shall inform the client in writing about the requirements for the necessary preoperative examinations, which means, in particular, a list of the necessary examinations and information on whether these examinations can be performed at the PSZ or whether the client is required to arrange the examinations themselves. If the client arranges the preoperative examination themselves, they are obliged to send the results to the intermediary in the predetermined scope no later than 5 days before the planned procedure. The intermediary is not responsible for late or incomplete delivery of the results of the preoperative examination.

8.

The client has the right to change the date of the procedure once in writing or by email before the consultation with PZS, under the following conditions:

• change of date 30 days or more before the procedure: fee of EUR 50

• Change of date less than 30 days to 16 days before the procedure: a fee of 50% of the deposit paid, up to a maximum of EUR 500

• Change of date 15 days to 1 day before the procedure: a fee of 80% of the deposit paid, up to a maximum of EUR 700.

The alternative date for the procedure must be agreed no later than 6 months after the original date.

9.

If the date of the procedure is canceled for reasons attributable to the client, the agent is entitled to a fee of 100% of the advance payment, up to a maximum of EUR 900. The EUR 900 fee limit does not apply in the following cases, where the full deposit paid will be charged, i.e. without the maximum limit:

• the procedure will not take place after consultation with the PSZ due to negligence or false statements or concealment of facts regarding the client’s health condition,

• the client does not excuse their absence at least 24 hours before the agreed date of the procedure,

• failure to deliver or delivery of incomplete preoperative examination.

10.

If the procedure is canceled after consultation with the PSZ

• due to a temporary contraindication by PZS, the client undertakes to schedule a replacement date for the operation, which will be no later than 6 months from the original date. In such a case, the deposit will be reduced by a handling fee of EUR 150 and any costs for preoperative examinations (if the client has not paid them directly to m

The cancellation fee will be deducted from the advance payment. If the client is entitled to a refund of the advance payment or part thereof, this claim will be settled within 30 days.

12.

If the procedure is canceled by the agent or PZS for reasons attributable to them, the client will be refunded the entire advance payment.

13.

If the procedure cannot take place due to force majeure or other reasons beyond the agent’s control, no legal claims can be made against the agent or PZS.

14.

Accommodation booked by the agent can be canceled free of charge no later than 3 days before arrival. In case of later cancellation, the room cancellation fee according to the accommodation provider’s price list must be paid. The cancellation fee will be deducted from the advance payment.

15.

All information provided by the agent to the client is based on the agent’s previous experience with cooperating PSZs, is of a general nature only, and does not replace individual medical advice.

16.

The intermediary consults the planned procedures of clients based on the information provided by clients with selected partner healthcare providers at the discretion of the intermediary, before the procedure, during the stay at the healthcare provider, after the procedure, in order to fulfill its obligations under the contract and to properly provide the requested service. For the purpose of fulfilling the contract, the client is entitled to dispose of the content of postoperative communication, but only in communication with the healthcare provider for an unlimited period of time.

17.

The client is responsible for the content of the information provided by them.

18.

The intermediary is not responsible for procedures and related medical services, transportation, and accommodation in clinics or hotels, as these services are subject to a contract between the client and the healthcare provider, hotel operators, transportation companies, or taxi drivers. In the event of a complaint about the above services, the agent undertakes to provide the client with all necessary cooperation at the client’s request.

19.

The agent is not liable for defective performance or delay if this was caused by the actions of the client, a third party, or force majeure.

20.

The agent reserves the right to unilaterally change these terms and conditions, effective from the date of publication of the new version on the agent’s website. In such a case, the agent is obliged to notify the client of the change.

 

 

21.

The provisions of Section 1829 of the Civil Code shall not apply to a relationship based on a contract, i.e., the client may not withdraw from the contract within 14 days, as this is a statutory exception specified in Sections 1838 and 1840 of the Civil Code. In the event of withdrawal from the contract by the client, the procedure shall be governed in particular by paragraphs 8, 9, 10, and 11 of these terms and conditions.

22.

As the controller of personal data provided to it by the parties under the contract, the intermediary undertakes to process such personal data in accordance with the law, in particular Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data. Information related to the processing of the client’s personal data is available on the website www.medroyal.cz, and by concluding the contract, the client declares that they have read this information.

23.

All disputes between the intermediary and the client shall be settled by the competent courts in Prague.
